Coronavirus Update for Tier 2 and Tier 5 Sponsors

Tier 2 and 5 Reporting requirements

Visitor visa refusal reversedTier 2 and Tier 5 Sponsors do not have to report in the sponsor management system that a sponsored employee is working from home due to the Coronavirus pandemic.

Other changes must still be reported as usual. This includes changes in the number of hours, salary or any changes in core duties or job title.

Normally, sponsored employees are allowed to take up to four weeks unpaid leave per year. It has been confirmed that this leave can now be extended due to Coronavirus and does not have to be reported.

It is not clear if sponsored migrants can be on furlough – i.e. whether the employer can receive compensation from the government if they are unable to retain the worker due to the pandemic.

If you are a sponsor of migrant workers and consider changes to their employment contracts, we will be happy to advise on immigration compliance of the proposed changes and any associated procedures.

Please don’t hesitate to get in touch.
